Month: December 2014

Drive Sober or Get Pulled Over: Holiday Edition

The National Highway Traffic Safety Administration (NHTSA) is currently publicizing their 2014 Holiday Season Drive Sober or Get Pulled Over campaign. It’s no secret that the holiday season is usually a pretty dangerous time to be on the roads in Texas and across the U.S. In addition to everyday commuters, seasonal travelers are taking to the highways and interstate roadways. On top of everything, more people are celebrating with alcohol this season, from Thanksgiving and Christmas to New Year’s Eve.

Holiday Crash Facts

  • In 2012, during the holiday period (December 12-31) 1,698 people were killed in crashes across the U.S.
  • Nearly a third of those fatalities were due to drunk-driving crashes.
  • On Christmas Day alone, 26 people were killed by drunk drivers in 2012.
  • From 2008-2012, a total of 3,994 people were killed in crashes with impaired drivers in the months of December.
  • In December of 2012, 830 people were killed in drunk driving crashes across the country.

Holiday Driving Safety

First, the NHTSA wants motorist to know that buzzed driving is drunk driving. Even one drink can be one drink too many, so if you plan on celebrating with alcohol, find a safe ride home. Never get behind the wheel, it’s not worth even one lost life during the holidays or anytime of year. Drivers and passengers are also strongly encouraged to buckle up for every trip, no matter how short. Whether you’re traveling cross-country or across town, buckle up. It’s the single most effective way to protect yourself in a crash.

Police Officers Out in Full Force

State and local law enforcement agencies will be out in full force this holiday season in efforts to keep the roadways safe for travelers and commuters too. Law enforcement agencies are hoping that increasing patrols and national high-visibility campaign materials will help to reduce the potential number of injury-causing and fatal drunk driving crashes this holiday season.

After an Accident

If you’ve been injured in a drunk driving accident this holiday season, contact a skilled personal injury attorney as soon as possible to get the ball rolling on your case. You should be enjoying the holidays with your family, not worrying about how the medical bills are going to get paid. Let your attorney handle the details. The team at the Altman Legal Group wishes everybody a safe and happy holiday season.

WF Man Killed in Semi Truck Wreck

On Sunday, a Wichita Falls man was killed after his pickup truck collided with a semi truck in Stephens County, Oklahoma. According to News Oklahoma, the incident happened sometime after 10:00 a.m. on State Highway 29, near Wrights Corner. For currently unknown reasons, 36-year-old Aaron Esquibel’s pickup truck collided with a semi truck. The commercial truck was carrying an oversized load, but there’s no word on whether or not that had anything to do with the wreck.

Big Rig Wreck in Oklahoma

We do know that the roadway was wet at the time of the crash, but authorities haven’t said whether or not the weather was a factor for the crash. News Oklahoma reports that Esquibel was headed east at the time of the crash, and the big rig, driven by 62-year-old Phillip Garside, was headed west. Sadly, Esquibel succumbed to his injuries on the scene. Garside did not report any injuries after the crash.

Federal Regulations for Semi Trucks

Since this crash is still under investigation with authorities, very little information has been released. Crashes involving tractor trailers and commercial trucking vehicles often require much more in depth investigations. Semi truck drivers and trucking companies have a variety of additional federal safety regulations to follow for legal operation. These vehicles are so much larger and heavier than other automobiles on the roadway. The Federal Motor Carrier Safety Administration (FMCSA) is the agency tasked with regulating the commercial trucking industry.

Big Rig Crashes in Texas and Oklahoma

Since commercial trucks are so large, drivers, owners and operators have additional rules to follow to keep everybody on the roadways safe. This means that if you or a loved one has been injured in a crash involving a semi truck, the investigation will typically be much more complicated and lengthy than if only traditional passenger vehicles were involved. This is why it’s important to have an experienced personal injury lawyer on your side after a wreck.

After a Tractor Trailer Crash

After any kind of wreck, it’s a good idea to speak with a personal injury attorney. Cases involving big rigs can be especially complicated due to the federal regulations involved. An attorney can stay on top of investigative developments from multiple agencies and make sure your rights are being protected. The team at the Altman Legal Group sends their deepest condolences to the family members and friends of Aaron Esquibel.

Electrical Fire in Altus

On Thursday evening, an electrical fire displaced a family in Altus, Oklahoma. The incident happened on the 700 block of Judy Avenue. According to KSWO Channel Seven News, the tenant, Christie Harper, and her family were not home when the fire started. Harper was called, but arrived on the scene too late to do anything about the blaze. She shares the home with her 15-year-old son and 18-year-old daughter who is expecting a baby. First responders were able to put the fire out, but not before it caused extensive damage to the home.

Fire Started in Electrical Outlet

The fire appeared to have started in an electrical outlet in what was going to be the new baby’s nursery. Thankfully, the family was not in the house at the time of the fire, but they did lose all of their Christmas gifts, and items for the new baby. They lost baby clothes, laptop computers and a variety of other essential household items and Christmas gifts. At the time KSWO Channel Seven News reported on the story, Harper’s daughter was being rushed to the hospital for delivery.

Faulty Electrical Outlets

Although very few details have been released about how the electrical outlet could have caught fire, one thing is for certain. The Harper family sustained considerable property damage and loss as a result of the fire. Faulty electrical outlets can be extremely dangerous. Whether anyone is home or not, a small electrical fire can quickly turn into a large dangerous blaze. If you suspect faulty wiring or a defective electrical outlet was to blame for a fire in your house, you need to speak with a fire damage attorney as soon as possible.

Property Damage Due to a Fire

Renters and homeowners alike can sustain severe property damage and loss after electrical fires in the home. Even with insurance, it can be incredibly difficult to recover, replace and rebuild after a house fire. The holidays are an especially difficult time to deal with property damage and loss too.

When to Call a Fire Damage Attorney

Whether you’ve suffered partial damage to the home or a total loss of the property, an electrical fire can uproot your life in an instant. If you have suffered property damage or loss due to a house fire in Texoma, contact the skilled fire damage team at the Altman Legal Group for a free case consultation today.

Lawton Woman Run Over by Car

On Monday night, a woman in Lawton, Oklahoma was run over by a car. According to KSWO ABC News Channel Seven, the incident happened in the 2100 block of Northwest Bessie Avenue. Witness reports indicate that two people were having an argument, when the suspect, Tayrean Miller, tried to push the victim, Darnesha Fuller, into his car. A person who knew Fuller tried to intervene, but said that the car ran her over.

Victim Suffers From Multiple Injuries

It’s also possible that Miller got back into the car and ran Fuller over a second time. She was rushed to the hospital, where she was treated for injuries to her head, left side of her body, both legs, hip and back. Other than witness reports, very few details have been released about this crash. There’s no word on Fuller’s current condition, or whether or not any charges have been filed against the driver.

Aggressive Driving Behaviors

Although the incident in Lawton is likely still under investigation, there’s always the possibility of aggressive driving and road rage when apparent altercations have occurred. If a person has intentionally run over another person, multiple times, there could be criminal charges pending.

Road Rage Facts

  • Aggressive driving causes 66 percent of car crash fatalities.
  • Males under the age of 19 are most likely to exhibit road rage.
  • Over a third of aggressive driving incidents involve a firearm.

Road Rage in Texoma

Aggressive driving behaviors can lead to road rage incidents. The National Highway Traffic Safety Administration (NHTSA) defines road rage as when a driver “commits moving traffic offenses so as to endanger other persons or property; an assault with a motor vehicle or other dangerous weapon by the operator or passenger of one motor vehicle on the operator or passenger of another motor vehicle.”

After an Accident in Lawton

If you have been injured in an accident with an aggressive driver, you need to call a personal injury attorney as soon as possible. Whether you were a pedestrian at the time of the accident or in another car, having an experienced personal injury attorney on your side is critical. In cases where criminal charges are involved, claims can quickly become complicated. Your attorney can stay abreast of investigative developments and be your advocate during a difficult time. The team at the Altman Legal Group wishes a full and swift recovery for Darnesha Fuller.

Wichita Falls Oil Field Worker Injured

On Thursday afternoon, an oil field worker was injured at a worksite off of FM 367. According to KFDX News Channel Three, the incident happened at Mitchell Ranch, near Highway 25. Christopher Beck, the 19-year-old victim, was injured when something went wrong with one of the booms. He was airlifted to the hospital due to the severity of the injury and the remote location of the worksite.

Oil Field Worker Suffers from Back Injury

Very few details have been released, but there was apparently a problem with a large wench truck. KFDX News Channel Three reports that part of the wench shifted and the booms came down, striking the oil field worker in the back and shoulder area. Although there’s no word on the extent of his injuries, Beck was reportedly treated and released.

Oil Field Accidents on the Rise

Oil field accidents are an all too common occurrence in the Texoma area. With the booming natural gas extraction industry in Texas, there has also been an increase in oil field related injuries and fatalities. In fact, the Centers for Disease Control and Prevention (CDC) found that fatality rates in the oil and gas extraction industry are actually on the rise, rather than showing an equal increase with industry growth.

Oil Patch Injuries

Depending upon the circumstance, injuries in the oil patch can vary greatly. Since there is the potential for explosions, burn injuries are commonly seen on the oil field. The severity of this type of injury can also vary greatly from minor burns and smoke inhalation to death. Accidents involving heavy machinery can lead to severe head and spinal cord injuries and amputation injuries. In addition to hazards on the oil patch, the increase in commercial trucking traffic also puts workers and other motorists at risk.

After an Oil Field Injury

After an oil field injury, it’s important to speak with an experienced personal injury lawyer as soon as possible. Whether you’re recovering from a burn injury related to an explosion or a catastrophic injury involving heavy machinery failure, you need to call an attorney to get the ball rolling on your case. You’re out of work and in the hospital, and you need an advocate looking out for you and your family’s best interests. The team at the Altman Legal Group wishes Christopher Beck a full and speedy recovery from his injuries.

Trailer and Barn Fire in Iowa Park

Earlier this week, a trailer and a barn burned down in the Iowa Park area. According to KFDX News Channel Three, the fire started sometime before midnight, in the 2400 block of FM 367. Deputies, first responders and firefighters with the local fire and police departments were swiftly on the scene, where the barn and RV trailer home were already fully engulfed by flames. Very few details have been released about this fire. Thankfully, no injuries were immediately reported, but the cause of the fire is still under investigation with authorities.

House Fire in Wichita Falls

Just last month, we reported on a house fire that displaced a family in Wichita Falls. The fire was thought to have started somewhere in the attic, and 17 firefighting and law enforcement units worked to contain the blaze. Thankfully, the two people inside of the home and their dog were able to get out of the house before it was completely engulfed in flames.

‘Tis the Season for House Fire Safety

With dipping temperatures, more families are looking to space heaters to warm their homes. Unfortunately, space heaters accounted for about one third of all home heater fires from 2007 to 2011. The National Fire Protection Association has a variety of tips for safely using space heaters during the cold weather. Consumers are always encouraged to follow the manufacturer’s instructions. If you think your space heater is defective, contact the manufacturer immediately, and if a faulty space heater caused a fire in your home, call an experienced personal injury lawyer as soon as possible.

Recovering From a House Fire

The holiday season can be an especially difficult time to recover from a house fire. Even if you and your family escaped without injury, you could be looking at serious property damage or a total loss of your home. In most cases, it’s impossible to even grab a few essential items or heirlooms on the way out the door. You literally escape with the clothes on your back.

When to Contact a Fire Damage Lawyer

If you have been injured in a fire due to a defective space heater, you need to speak with a personal injury lawyer who has fire damage experience as soon as possible. It may be necessary to conduct additional investigative efforts to determine the cause of the fire, so the sooner you speak with an attorney, the better.
