Drunk Driver Injures Lawton Motorcyclist

On Saturday, a drunk driver in Lawton sent a motorcyclist to the hospital. According to KSWO ABC News Channel Seven, the wreck happened sometime around 6:45 p.m. on Cache Road, near 21st Street. Apparently, an SUV driver pulled out onto Cache Road in front of the motorcycle. The female motorcycle rider was swiftly transported to the hospital for treatment of injuries. She suffered from a broken arm and hip injuries. At least three lanes of traffic had to be closed as first responders and crews worked the scene.

SUV Driver Arrested

The driver of the SUV was arrested and charged with driving under the influence (DUI). He did not suffer any injuries in the crash. Very few details have been released, and we do not know the age or name of the injured motorcycle rider. There has also been no word on her current condition.

Motorcycle Crash Facts

  • In 2012, 4,957 motorcyclists were killed in crashes across the U.S.
  • From 2011 to 2012, there was a seven percent increase in motorcycle crash fatalities.
  • In 2012, an estimated 93,000 motorcyclists were injured.
  • In 2012, an estimated 81,000 motorcyclists were injured.
  • Per vehicle mile traveled, motorcyclists were 26 times more likely than passenger car occupants to die in a traffic crash in 2012.

Share The Road

The National Highway Traffic Safety Administration (NHTSA) is calling on drivers to Share the Road with motorcyclists. An important part of sharing the road is making a commitment to distraction-free driving. If you’re reading a text message, you’re not looking out for motorcycles and other roadway users. Drivers are also encouraged to check blind spots before changing lanes and remember to watch for motorcycles before pulling onto busy roadways.

After a Motorcycle Crash

Motorcyclists are a vulnerable roadway user group. They don’t have the added protection of a steel cage, seat belts and air bags. Even with helmets and other protective gear, they’re at the mercy of other drivers on the road. If drivers are distracted, impaired or just plain reckless, motorcyclists, motorists, pedestrians and other roadway users are put at great risk. If you have been injured or if you have lost a loved one in a motorcycle accident, contact a skilled personal injury lawyer as soon as possible.

The team at the Altman Legal Group wishes the injured motorcyclist a full and swift recovery from her injuries.

Woman Shot in Road Rage Incident

A Houston woman is recovering from a gunshot wound after a possible road rage incident last Friday. According to KFDX News Channel Three, the altercation happened sometime around 7:00 a.m., near the Airtex exit along Interstate 45. Apparently, the woman honked her horn at another motorist after being cut off in traffic. The offending driver then pulled up next to her car and fired a shot through her passenger window.

28-Year-Old Woman Shot in Road Rage Incident

The bullet struck the back of her head. The victim, 28-year-old Kay Hafford, was able to pull over and dial 911. By the time first responders arrived on the scene, she was in and out of consciousness. She was then swiftly taken to Memorial Hermann Texas Trauma Institute in the Texas Medical Center for treatment. As of the Friday afternoon, her condition was still listed as fair.

Road Rage Driver at Large

When KFDX News Channel Three reported on the incident, law enforcement officials had still not been able to locate the shooter. He was described as wearing a blue baseball hat and driving a white SUV. There’s no word on the make or model, or if there have been any leads. Anybody with information is being asked to come forward.

Aggressive Driving and Road Rage in Texoma

Aggressive driving puts motorists in Texoma in great danger. Although we usually think of road rage cases as involving weapons and threatening gestures, a variety of aggressive behaviors behind the wheel can endanger lives and lead to cases of dangerous and deadly road rage. Aggressive driving is dangerous enough in itself without having an escalation of road rage involved too. Listed below are a variety of different behaviors that can be considered aggressive behind the wheel.

Common Types of Aggressive Driving

  • Speeding
  • Tailgating
  • Improper lane changing
  • Gestures
  • Excessive or aggressive horn honking
  • Inappropriate parking
  • Blocking lanes
  • Excessive or aggressive eye contact
  • Blocking traffic

OHP Trooper Seriously Injured in Crash

On Thursday night, a trooper with the Oklahoma Highway Patrol was seriously injured in a crash on Highway 183. According to KFDX News Channel Three, the incident happened in the southbound area of the highway. Apparently, Trooper Gary Sanders had pulled a vehicle over when another vehicle crashed into the back of his patrol car. The patrol car then struck the automobile he had initially pulled over.

OHP Trooper Injured in Wreck on Highway 183

The injured trooper was immediately rushed to Frederick Hospital to be stabilized before being air lifted to United Regional. There’s no word on whether or not anybody else was injured in this wreck. Additionally, no information has been released on the extent of Sanders’ injuries or his current condition. We also don’t know if the driver that rear-ended his patrol car was cited or how this crash could have happened. Could it have been a case of distracted or impaired driving? Very few details have been released, and the crash is likely still under investigation with law enforcement authorities.

Move Over Laws

Texas and Oklahoma have “Move Over” laws that require motorists to move over a lane or slow down for first responders like police officers, state troopers and fire fighters. Additionally, Texas’ Move Over law was expanded to include Texas Department of Transportation (TxDOT) workers. Drivers are required to move over or slow down if they see the flashing blue lights of a first responder or the flashing amber lights of a roadway worker. These laws ensure roadway workers can safely do their jobs and return home to their families at the end of the day.

Respecting and Protecting First Responders

These Move Over laws were put into place to protect our first responders and roadway workers. Highway troopers and other road workers have incredibly dangerous jobs. Although we typically think of shootouts and “bad guys” as primary dangers for cops, but car crashes are actually the most dangerous risks facing men and women in uniform.

Brave men and women in law enforcement, emergency medical services and fire rescue risk their lives to protect us all. The least we can do is respect and protect them by moving over a lane and slowing down so they can do their jobs safely. The team at the Altman Legal Group wishes Trooper Gary Sanders a full and swift recovery from his injuries and appreciates his service.

Child Killed in ATV Crash

Last week, a 10-year-old boy was killed in an ATV (All Terrain Vehicle) crash at the Rednecks With Paychecks celebration near Saint Jo. According to KFDX News Channel Three, the child, Nicholas Torres of Fort Worth, was riding between two trailers when the four-wheeler he was on collided with a pickup truck. Although very few details about the crash have been released, we do know that he was not wearing a helmet at the time of the wreck.

10-Year-Old Fatally Injured in Four-Wheeler Crash

Although Torres was rushed to the hospital, he died as a result of his injuries. KFDX News Channel Three also reports that the four-day Rednecks With Paychecks event had about 10,000 participants this year.

ATV Crash Statistics

  • Between 1982 and 2012, there were 12,391 ATV-related deaths.
  • Nearly a quarter of those victims were under the age of 16.
  • 353 of those deaths occurred in 2012.
  • In 2012, an estimated 107,900 people were injured in ATV crashes.
  • An estimated 26,500 of those injuries happened to children under the age of 16.

All-Terrain-Vehicle Safety

As the weather gets nicer, more and more people will be out on ATV’s, four-wheelers, dune buggies, dirt bikes and other recreational vehicles. It’s important to remember that while these off-road vehicles are fun, they’re not without risk. Safety for drivers and riders depends upon correct operation of the vehicles and the use of safety equipment, like helmets, boots and gloves.

Injured on Somebody Else’s ATV

Many of the injuries and deaths that occur on ATV’s and other recreational vehicles happen on somebody else’s recreational vehicle. Riding a friend’s ATV isn’t always a good choice, especially if you don’t have experience or any training. Also, your friend may not provide appropriate safety gear like well-fitted helmets, boots or gloves. Underestimating risk or not being properly taught to operate the vehicle can also both contribute as potential factors involved in some ATV crashes.

Safety First

With good weather on the way, more and more people will be taking to their ATV’s and other off-road recreational vehicles. It’s absolutely essential that safety come first. Always wear a well-fitting safety certified helmet and safe footwear and clothing. In the event of a wreck, you’ll have a much better chance at avoiding injury.

The whole team at the Altman Legal Group sends their deepest heartfelt condolences to the family members, friends and loved ones of Nicholas Torres.

St. Patrick’s Day Drunk Driving Prevention

This year, the annual St. Patrick’s Day Festival falls on Saturday, March 14th. Gates open at 4:30 p.m. and the street celebration lasts until 10:30 p.m. Not only is St. Patrick’s Day notorious for green beer and other alcoholic beverages, it’s also, not surprisingly, associated with a spike in drunk driving related injury-causing and fatal crashes. As with any Saturday night celebration involving alcohol, partygoers are encouraged to make responsible arrangements to ensure safe rides home. The National Highway Traffic Safety Administration (NHTSA) is currently getting the word out about their annual St. Patty’s Day DUI Prevention campaign too.

St. Patty’s Day Drunk Driving Facts

  • In 2013, two out of every five crash deaths over St. Patrick’s Day weekend involved a drunk driver.
  • On St. Patty’s Day weekends from 2009 to 2013, 276 people were killed in drunk-driving crashes.
  • In the post-party hours of March 18, 2013, over half of all crash fatalities involved drunk drivers.
  • On St. Patrick’s Day in 2013, 31 people died in drunk-driving crashes.

St. Patrick’s Day Drunk Driving Prevention

The best way to prevent drunk driving is to refrain from engaging in it. There is no such thing as ‘okay to drive,’ if you’ve been drinking. Planning ahead is the best way to ensure a smooth and safe ride home. If you’re going with a group of friends, designate a driver ahead of time. If you’re going alone or everybody in your group plans on drinking, line up some other form of transportation. Pre-program a cab company’s number into your phone, so you’re not scrambling around for a ride at the end of the night. Whatever you do, don’t get behind the wheel, and keep an eye on your friends too. Friends don’t let friends drive drunk.

Increased Law Enforcement

Not only does designating a driver keep roadways safer, it can also keep you out of jail. Law enforcement officers across Wichita Falls and Texoma will be stepping up their efforts to catch drunk drivers, so do yourself a favor and get a safe ride home.

After an Accident Involving a Drunk Driver

After a crash involving a drunk driver, you need to speak with an experienced personal injury attorney. Your lawyer will be able to stay on top of investigative reports and be your advocate during a difficult time. The team at the Altman Legal Group wishes everybody a safe and Happy St. Patrick’s Day.

Fatal Crash Involving Graham Church Van

On Friday afternoon, two people were killed and at least three others were severely injured in a crash involving a church van out of Graham. According to KFDX News Channel Three, the incident occurred sometime around 5:30 p.m., about two miles north of U.S. 180 on State Highway 377 near Mineral Wells, in Palo Pinto County. Multiple victims had to be airlifted to hospitals in Fort Worth.

Head-On Deadly Collision Involving Church Van

For currently unknown reasons, the church van collided head-on with another car on the road. At this time, very few details have been released about the deadly crash, which is likely still under investigation with law enforcement authorities. We do know that teenagers were riding in a van belonging to Faith Center Church, in Graham. The driver of the car, Jessica Lee Harris, and one person inside of the van, Stacey Daily, were killed in the crash. The forceful impact of the wreck caused the car to burst into flames and the van to overturn in the roadway.

Victims Recovering From Injuries

KFDX News Channel Three also reports that an 11-year-old girl was listed in critical condition, and she sustained fractures in her back, neck, pelvis and legs. Additionally, a teen also suffered from multiple fractures and foot injuries and was also listed in serious condition. Kenny Wemer, the 49-year-old driver of the van, was taken to a hospital in Fort Worth for treatment of injuries as well. At this time, we don’t know the full extent of injuries or whether or not these victims’ statuses have improved.

Crashes Involving Passenger Vans

The National Highway Traffic Safety Administration (NHTSA) has conducted extensive research to determine why passenger vans are at a greater risk for rollover than smaller traditional cars and light trucks. The increased rollover risk is attributed to three possible factors.

Passenger Van Rollover Risk Factors

  1. Inexperienced drivers
  2. Improperly sized and/or inflated tires
  3. Incorrectly loaded cargo and passengers that affect center of gravity.

Although there’s no word on whether or not anybody inside of the van was buckled up, it’s all too common to see passenger van crashes where very few occupants were buckled up.

The team at the Altman Legal Group sends their deepest condolences to the family members, friends and loved ones of Jessica Lee Harris and Stacy Daily. We also wish full and swift recoveries for the injured victims.

Multi-Car Crash on U.S. 75

Last Friday morning, 15 cars and two semi trucks were involved in collisions on U.S. Highway 75. According to KFDX News Channel Three, multiple drivers lost control of their vehicles causing separate collisions. Witness reports indicate that some cars were struck multiple times. At least two people were hospitalized, but there’s no word on the extent of their injuries or their current conditions.

Icy Roadways Across Texoma

Over the past few months, we’ve reported on a variety of wintry weather conditions impacting roadways in Wichita Falls and across North Texas. In early February, the driver of an SUV lost control of the vehicle crossing an overpass. In the first week of January, there were close to 100 wrecks, including seven jackknifed semi trucks, across the Texoma area.

Driving Too Fast For Conditions

Driving too fast for conditions is a frequent cause for collisions during inclement weather. Motorists are expected to tailor their driving to the conditions of the road. If you’re in icy weather, you probably shouldn’t be reaching the maximum speed limit on most roadways across Texoma. Safely regulating your speed isn’t just for icy weather either. No matter what weather conditions you encounter, whether it’s snow, ice, rain, fog or some other type of weather or roadway condition, you should always adjust your speed for safe travel.

Allowing Extra Distance Between Vehicles

An important component to safe driving during poor weather conditions is allowing extra distance between vehicles, especially for the vehicle in front of you. If the driver in front of you has a problem or some kind of emergency, you will need extra distance to stop. If you’re too close to somebody who hits some kind of hazard in the road, you could easily rear-end that car. Pileups and chain-reaction crashes in bad weather (and good weather) are often due to drivers being too close to one another. Give the driver in front of you plenty of room.

Being a Savvy Winter Weather Driver

Being a savvy winter weather driver means always adjusting your speed to the conditions of the weather or road, making a commitment to distraction-free driving and allowing extra distance between your car and the car in front of you.

If an aggressive or dangerous driver has injured you during inclement weather, contact the skilled team at the Altman Legal Group at 940-761-4000 for a free case consultation today.

Flooring Linked With Cancer Causing Chemical

Lumber Liquidators is popular for a reason, they’re an affordable choice for homebuilders, contractors and homeowners shopping for flooring. Unfortunately, that good deal on laminate flooring could come at the cost of your family’s health.

Lumber Liquidators, the popular flooring retailer with locations nationwide, is under heat for selling flooring with potentially unsafe levels of the cancer-causing chemical formaldehyde. A recent investigative report by 60 Minutes revealed the disturbing news that much of the company’s Chinese-made laminate flooring could contain unsafe levels of the dangerous chemical formaldehyde. Initial estimates indicate that the tainted laminate flooring could be in hundreds of thousands of homes nationwide.

Results of Independent Lab Testing

Concern over the flooring has California homeowners ripping out their floors. They believe the Chinese-made laminate flooring is making them sick. With Denny Larson, executive director of Global Community Monitory, and Richard Drury, an environmental attorney, on the case, they had over 150 boxes of laminate flooring from a variety of different home improvement stores and flooring retailers tested.

The results were startling. Samples from Home Depot and Lowes had acceptable levels of formaldehyde, but every single sample of Chinese-made flooring from Lumber Liquidators failed to meet California Emission standards. Some samples were close to 20 times over the legal level.

Dangers Associated with Formaldehyde

Formaldehyde is a carcinogen, or cancer-causing chemical. At certain levels, it can also lead to chronic respiratory irritation, change in lung function, increased risk of asthma. Children and pregnant women are at an especially high risk when exposed to carcinogens. Initial symptoms of exposure can include a sore throat, burning and itching of the nasal passages and nasal congestion. At high levels, formaldehyde can cause myeloid leukemia and nasopharyngeal cancer.

Chinese Mills Implicated in Scam

During the investigative report, 60 Minutes found that three mills manufacturing Lumber Liquidators’ laminate flooring admitted to falsely labeling the flooring as meeting US emissions standards. This practice saves Lumber Liquidators 10 to 15 percent on manufacturing costs, and they pass the savings on to you. Meanwhile, they’re profit margin is doubling at an unprecedented rate, alerting those in the financial sector of possible foul play.

Chinese Formaldehyde Tainted Flooring is Cheaper

Lumber Liquidators needs to be held accountable for selling Chinese-made formaldehyde tainted flooring to consumers all over the country. Saving a buck at the expense of American health and lives is an unacceptable business practice.
