The Dangers of e-Cigarettes

A recent article out of the Times Record News highlights the dangers of smoking e-cigarettes, and that the Wichita Falls- Wichita County Public Health District wants residents to be aware of emerging research regarding the connection between a common chemical used in e-liquid for vaping and e-cigarettes and an incurable disease known as “Popcorn Lung.” For years, e-cigarettes have been touted as a safer alternative to smoking traditional cigarettes or as a safe cessation device. Unfortunately, a 2015 study out of the Harvard School of Public Health found that e-cigarettes are actually a lot more dangerous than we’ve been led to believe.

Diacetyl and “Popcorn Lung”

In the early 2000s, the term “Popcorn Lung” was made famous after a worker from a popcorn factory developed an incurable lung disease called Bronchiolitis Obliterans due to inhaled exposure of the chemical diacetyl. Diacetyl, one of the chemicals responsible for that delicious buttery flavor that we love on microwave popcorn, is actually extremely dangerous when inhaled. This degenerative lung disease, which initially starts with a shortness of breath and coughing, progresses until the lungs no longer function due to scarring.

Diacetyl and e-Cigs

What many e-cig users may not know is that diacetyl has been found in about 75 percent of e-cigarette liquids. This extremely harmful carcinogenic chemical, that is dangerous when inhaled, is used as a flavor additive in about three-quarters of all e-cigs, and at this time, e-cigarettes are not regulated by the U.S. Food and Drug Administration (FDA).

Getting The Word Out in Wichita Falls

Officials in Wichita Falls and at other small public health agencies in Texas and across the nation aren’t waiting on the FDA to do the right thing. The general public has been led to believe that vaping is a safe alternative to smoking traditional cigarettes, when in reality, that’s just not the case. Public health officials in Wichita Falls are actively working to get the word out about the dangers of vaping and e-cigs. They’re also offering a variety of free resources, including information on how to get a free two-week’s allotment of nicotine patches and how to enroll in a Fresh Start class to help you successfully quite smoking or vaping.

If you or somebody you love has developed Bronchiolitis Obliterans (Popcorn Lung) due to vaping e-cigarettes, you need to speak with an experienced personal injury attorney about your case.

$502 Million Verdict in DePuy Hip Implant Case

A jury in Texas recently awarded a $502 million verdict against Johnson & Johnson in a case involving their defective DePuy Pinnacle hip implant device. This news came after 37 days of testimony from both sides and input from expert witnesses. An article out of The Expert Institute reported on the recent jury decision. This 10-week trial in the U.S. District Court in the Northern District of Texas involved five plaintiffs who received the allegedly defective DePuy Pinnacle hip implants. They were awarded $142 million in compensatory damages and an additional $360 million in punitive damages. The outcome of this trial will likely impact additional upcoming lawsuits for around 7,000 patients across the nation.

Defective DePuy Pinnacle Hip Implant

These metal-on-metal hip replacement devices have been fraught with problems ever since they hit the market. The DePuy Pinnacle implant devices are used for patients who require complete hip replacements. This includes a replacement of both the socket and the top of the thighbone. Unfortunately, in the Pinnacle device, both of these parts are made of metal. Like in any joint capsule, there is a lot of movement going on, and these components can rub against each other. This causes the metal pieces to release debris inside the body. This can lead to elevated blood levels of both cobalt and chromium ions. There can also be structural integrity problems, and many patients have to undergo an additional revision surgery to remove the implant due to complications.

Complications of DePuy Pinnacle Hip Implants

  • Implant loosening
  • Metal poisoning of the blood
  • Shedding of metallic debris in the body
  • Difficulty walking or standing
  • Extreme pain
  • Intense soft tissue damage
  • Complete failure of hip implant device

What to do if Your DePuy Pinnacle Hip Implant Fails?

First and foremost, you need to speak with your doctor about the immediate medical complications and issues you’re dealing with. If you have a DePuy Pinnacle hip implant device and you’re having any kind of abnormal pain or other issue, contact your doctor immediately. Once your immediate and pressing medical needs have been addressed, you need to get into contact with a personal injury lawyer.

If you or a loved one has suffered from complications of a defective DePuy Pinnacle hip implant device, contact the skilled and proven team at the Altman Legal Group at (940) 761-4000 for a free case consultation.

The Dangers of E-Cigarettes

Although e-cigarettes have been touted as a safer alternative to smoking traditional cigarettes, a new study from the Harvard University T.H. Chan School of Public Health suggests otherwise. The research links e-cigarette use with an increased risk of developing a serious and incurable respiratory disease called bronchiolitis obliterans. This incurable disease is commonly known as “Popcorn Lung.”

The Research

Researchers at Harvard University tested 51 types of flavored e-cigarettes and flavor canisters. They were looking for diacetyl, acetoin, and 2,3-pentanedione. These three chemicals are known to cause respiratory problems in factor workers. The study found at least one of the three chemicals in 47 of the 51 products they tested. They tested a variety of flavors including bubble gum, cotton candy and tutti frutti. Many flavors found to contain the dangerous chemicals are popular among young and teen e-cigarette users.

What is Popcorn Lung?

Bronchiolitis obliterans, also known as Popcorn Lung, is an irreversible, life-threatening, obstructive lung disease. The term Popcorn Lung was coined when workers in a popcorn plant in Jasper, Missouri developed the disease. The workers inhaled airborne diacetyl, a chemical used in artificial butter flavoring. The workers developed the disease, and the media started calling it Popcorn Lung. Bronchiolitis obliterans starts with a cough and progressively gets worse as the bronchial wall thickens. Since the workers and a consumer of microwave popcorn came down with bronchiolitis obliterans, many popcorn companies have switched from using diacetyl to other types of flavoring.

What About Safety Regulations?

At this time, the Food and Drug Administration (FDA) is not regulating the e-cigarette industry. Since e-cigarettes are still relatively new to the market, there hasn’t been much research done on long-term risks associated with their use, and the e-cigarette industry has basically been doing whatever they want, regardless of the consequences. It’s reminiscent of the early tobacco cigarette days. The Harvard researchers found diacetyl, a chemical known to cause Popcorn Lung, in 75 percent of e-cigarette flavors tested.

Thankfully, proposals are being made to extend the FDA’s authority over e-cigarettes. There’s no telling how long that could take or how many people are being put a risk for developing such a damaging and incurable respiratory disease. It’s really only the popularity with the teen demographic that has prompted FDA interest in e-cigarette regulation. Many states allow minors to purchase e-cigarettes and 45 out of 50 states allow the use of e-cigarettes in smoke-free venues.

General Motors Recall Due to Faulty Ignition Switches

KFDX News Channel Three has recently reported on the massive automobile recall being conducted by General Motors. According to General Motors’ website, the recalled models need to have their faulty ignition switches corrected. This defective ignition switch may allow the key to unintentionally move or switch to the ‘accessory’ or ‘off’ position. If this occurs when you are driving, the engine and most of the vehicle’s electrical components can turn off suddenly. If your car is on the recall list, you should contact GM right away, if you haven’t already heard from them, and find out when and where you can get your car fixed.

Getting Recalled Items Addressed Immediately

If your car is being recalled for any reason, you should immediately follow the manufacturer’s instructions and get the problem addressed as soon as possible. A faulty device or defective piece of equipment on an automobile can have devastating or deadly consequences. The National Highway Traffic Safety Administration (NHTSA) is currently publicizing this recall as a consumer alert. If your car is being recalled for this issue, GM recommends taking heavy key rings off of your car key before starting or driving your automobile. You should only start and drive your car with one single ignition key, and get your car repaired as soon as parts become available from GM. It’s also a good idea to contact your local GM dealership or service center about the issue.

Recalled Models

  • 2005-2007 Chevrolet Cobalt, Pontiac G5, and Pontiac Pursuit
  • 2003-2007 Saturn Ion
  • 2006-2007 Chevrolet HHR
  • 2005-2007 Pontiac Solstice
  • 2007 Saturn Sky

Additional Vehicles Being Recalled by GM for Different Issues

  • 2009- 2014 Chevrolet Express and GMC Savana with gross vehicle weight under 10,000 lbs
  • 2013-2014 Cadillac XTS full-size sedan
  • 2008-2013 Buick Enclave and GMC Acadia
  • 2009- 2013 Chevrolet Traverse
  • 2008-2010 Saturn Outlook

Reporting Faulty Items to the NHTSA

If you think something is defective in your car, you should file a complaint with the NHTSA immediately. Reporting safety information to the NHTSA is an important part of keeping roadways safe. The NHTSA has the ability to record and track vehicle information and track trends about potentially faulty devices and automobiles. They have a really easy form to fill out. You can even sign up for email alerts or download their app to stay abreast of recall information for your specific vehicle.

Graco Car Seat Recall Due to Faulty Harness Buckle

Graco has recently issued a press release which is announcing their voluntary recall of nearly 3.7 million car seats and booster seats. KFDX News Channel Three recently reported on the faulty buckles that may trap children in car seats. Apparently, the National Highway Traffic Safety Administration (NHTSA) received numerous complaints that parents had to use excessive force to get their children out of the car seat and booster seat harnesses. The harness buckle remains in the latched position, locking children in their seats. Many parents also reported having to cut the straps to free their children, because the buckle wouldn’t unlatch. Thankfully, Graco is responding to these complaints and is now conducting a voluntary recall.

The Recall

According to the manufacturer’s website, all toddler convertible car seats and harnessed boosters seats from 2009 to 2013, with a couple of exceptions, are being recalled. Listed below are the models that are currently being recalled. If you have one of these models, you need to contact Graco for a harness buckle replacement kit. The website is also encouraging consumers to clean their harness latches to see if that makes a difference. Ultimately, the safest option is to get the replacement harness buckle. If you registered your car seat or booster seat with Graco, you’re likely going to receive a letter about the situation. It doesn’t hurt to go ahead and contact the company for a replacement kit though.

Models Being Recalled

  • Cozy Cline
  • Comfort Sport
  • Classic Ride 50
  • My Ride 65
  • My Ride 70
  • My Ride 65 with Safety Surround
  • Size4Me 70
  • Head Wise 70
  • Head Wise 70 with Safety Surround
  • Ready Ride
  • Smart Seat
  • Smart Seat with Safety Surround
  • Nautilus 3-in-1 (booster seat)
  • Nautilus Elite (booster seat)
  • Nautilus Plus (booster seat)
  • Argos 70 (booster seat)
  • Argos 70 Elite (booster seat)

Keeping Children Safe

Although the company’s website says this malfunction doesn’t impact the effectiveness or usefulness of the car seat, this faulty harness buckle can be a serious problem in the event of a crash. Babies, toddlers and children need to be appropriately and safely restrained while the car is moving, but in the event of a crash, parents and first responders need to be able to free them quickly. When time is of the essence, the button on a latch needs to work. Lives could depend on it.
